Does anyone know what happened in the air NZ drug testing case ,it seems to have disappeared .I run a company that is looking at being forced into drug testing ,which I am against and was wondering the outcome up north if anyone can help Thamks icon_twisted.gif icon_mrgreen.gif

I don't know what happened with the case.

If you sign a contract with an employer which includes provision for drug testing, you have already consented to being tested. My suggestion....don't agree to it! I would never work for a company that included drug testing as a condition of employment, but if others do agree to be tested, then they should have that choice.

There is nothing wrong with a union fighting against the inclusion of a drug testing clause, but at the end of the day, you can only be tested if you have consented to doing so.

Yeah point granted .the stories this I work for a forestry consultancey company as a contractor ,Their new contract comes out in a couple months and it insists on pre-employment and random drug testing .Nice to say no but this is the main source of income for myself and 9 employees ?

Suggestions? know a good contrct lawyer icon_sad.gif

Contracts aren't a one way street, they are an agreement. If you have a union to negotiate on your behalf, and you wish to use them, do so.

Industrial action, if it come to that, is a perfectly legitimate way to get the conditions you want.

It is back in court on February 16th for an estimated three days.

There is lots about the court case on the website of the Engineering, Printing and Manufacturing Union (EPMU):
